1. Agreement to Terms
By accessing or using BlazeReply ("the Service"), operated by Jacinth Solutions Pty Ltd ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
BlazeReply is an Instagram DM automation platform that:
- Detects keyword comments on your Instagram posts
- Automatically replies to comments and sends direct messages on your behalf
- Uses AI to conduct follow-up conversations in DMs
- Collects and organizes lead information from these interactions
- Provides analytics on your automation performance
3. Eligibility
To use BlazeReply, you must:
- Be at least 18 years of age
- Have a valid Instagram Business or Creator account
- Have the authority to connect the Instagram account(s) you register
- Comply with Instagram's Terms of Use and Meta's Platform Terms
4. Your Responsibilities
When using BlazeReply, you agree to:
- Only connect Instagram accounts you own or have authorization to manage
- Not use the Service to send spam, unsolicited messages, or misleading content
- Comply with all applicable laws, including anti-spam legislation (such as the Australian Spam Act 2003)
- Not use the Service for any illegal, harmful, or fraudulent purpose
- Keep your dashboard password secure and not share access with unauthorized individuals
- Ensure your DM messages and comment replies comply with Instagram's Community Guidelines
- Respect Instagram users who do not wish to receive messages
5. AI-Powered Conversations
BlazeReply uses artificial intelligence (powered by Anthropic's Claude) to generate conversational responses in DMs. You acknowledge that:
- AI responses are generated automatically and may not always be perfectly accurate
- You are responsible for reviewing and configuring the AI's behavior through system prompts and goal settings
- The AI operates within the parameters you set (keyword configuration, goal type, max messages)
- You should monitor AI conversations regularly and take over when appropriate
- We are not liable for any misunderstandings or issues arising from AI-generated messages
6. Meta Platform Compliance
BlazeReply operates through Meta's official APIs. You acknowledge that:
- The Service depends on continued access to Meta's APIs, which may change at any time
- Meta may restrict or revoke API access, which would affect the Service's functionality
- You must comply with Meta's Platform Terms and Developer Policies
- We are not responsible for any actions taken by Meta against your Instagram account
- Instagram's messaging policies (including the 24-hour messaging window) apply to all automated messages
7. Pricing and Payment
BlazeReply offers free and paid plans as described on our pricing page. For paid plans:
- Prices are in USD and billed monthly
- You may cancel at any time; cancellation takes effect at the end of the current billing period
- We reserve the right to change pricing with 30 days notice
- Refunds are handled on a case-by-case basis
8. Intellectual Property
The BlazeReply platform, including its code, design, and content, is owned by Jacinth Solutions Pty Ltd. You retain ownership of your content (DM messages, keywords, lead data). You grant us a limited license to use your content solely to provide the Service.
9. Limitation of Liability
To the maximum extent permitted by Australian law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid us in the 12 months preceding the claim
- We are not responsible for Instagram account restrictions, DM delivery failures, or API changes by Meta
10. Account Termination
We reserve the right to suspend or terminate your access to BlazeReply if you:
- Violate these Terms of Service
- Use the Service for spam or illegal activities
- Cause harm to other users or to the platform
- Fail to pay for a paid plan
You may terminate your account at any time by disconnecting your Instagram accounts and contacting us at support@blazereply.com.
11. Data Deletion
In compliance with Meta's Platform Terms, you can request complete deletion of your data at any time. To request data deletion:
- Email support@blazereply.com with the subject "Data Deletion Request"
- Include your Instagram username and the email associated with your account
- We will process deletion within 30 days and confirm completion
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland, Australia.
13. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
